Terms Of Service Agreement


Internet usage may only be used for lawful purposes. The subscriber is solely responsible for ensuring that their use of the service is in compliance with all applicable laws and regulations. Transmission of any material in violation of any U.S., state, or local regulation is prohibited. This includes, but is not limited to - copyrighted material, material legally judged to be threatening or obscene. You may not use the Service for any unlawful or abusive purpose, in any way that could damage, disable, overburden, or impair.

 

Internet connectivity is only provided to the subscriber's location. Resale or use of the connection by another user or organization is prohibited.

 

Responsibility - IT Works LLC is responsible for providing internet to the customer location. Connectivity issues related to router, computer, or other peripheral devices using the Internet are not the responsibility of IT Works LLC. The subscriber is solely responsible for the care and maintenance of such. Radio equipment remains the property of IT Works.

 

Installation - IT Works LLC will install equipment at the subscriber's location for the charges listed. If the subscriber is in a rental property, it is the responsibility of the subscriber to obtain permission from the Landlord. Hardware shall remain the sole property of IT Works. In the event the subscriber or IT Works terminates service/s, it is the subscriber's responsibility to call IT Works LLC to make arrangements for the equipment to be collected. In the event the subscriber does not arrange for return of the Wireless Broadband hardware within 30 days of termination of service, the customer agrees to pay IT Works LLC $150. Customer agrees to indemnify and hold IT Works harmless from liability to any third parties, including the owner of the customer’s premises, for damage to the premises resulting from the installation, repair, maintenance, and removal of hardware furnished to provide the Wireless Internet Broadband.

 

Service Calls - After the installation of the services, any issues that may arise due to customer actions, such as cutting or damaging the cables, moving the equipment, or any other causes not related to the service provider's work, will result in a service call being necessary. Service calls are not included in the original installation price and will be billed separately. Service call fees will be charged at the standard hourly rate, with a minimum of one hour. The customer will be notified of the fee and will have the option to decline the service call. If the customer chooses to proceed with the service call, the fee will be added to the next billing cycle. The customer is responsible for ensuring that the service provider has access to the equipment and cables during the service call. If the customer is not present during the service call, the service provider will not be able to access the equipment and will need to reschedule the service call, resulting in an additional fee.

 

Internet Security - It is the sole responsibility of each subscriber to protect their computer(s), data, and network accessibility from unauthorized access or intrusion. IT Works LLC is not responsible for any unauthorized access or intrusion to the subscriber's computer(s), data, or network. It is solely your responsibility for implementing sufficient procedures and checkpoints to satisfy your network security.  The subscriber is solely responsible for any costs or damages resulting from their failure to implement appropriate security measures to protect their computer(s), data, and network accessibility. IT Works LLC shall not be liable for any damages arising from the subscriber's failure to secure their computer(s), data, or network.

 

Static IP - Public static IP address available upon request for a fee.  Addresses are in the private address range.

 

Billing Policy -  Services are paid in advance. Bills are generated and sent to the e-mail address you have on file. If the bill is not paid by the due date, which is the 1st of each month, a delinquency notice will be sent. If the delinquency is not paid by the 10th of the month, a late fee of $15.00 will be applied, and the service will be disconnected. Services will not be turned on until all fees are paid. If the disconnection date lands on a weekend, it is possible that service will not be turned on until the following business day. We reserve the right to refuse to leave your account "active" pending payment based on length of service, prior payment history, etc. Delinquent accounts are subject to disconnect anytime, and a charge of $15.00 will be added to your bill for reconnection.

 

Terms - IT Works reserves the right to change the rates and otherwise modify these Terms and Conditions at its discretion. An updated copy of this form will be provided upon request.  

 

Termination Policy

Termination by the Customer

  1. The subscriber may terminate this agreement by providing notice to IT Works LLC.  Upon termination, the subscriber must arrange for IT Works LLC access to pick up any and all equipment owned by IT Works LLC.  If the subscriber fails to return or arrange a return of the hardware, the subscriber agrees to pay IT Works LLC $150 for equipment.

  1. IT Works LLC reserves the right to terminate this agreement at any time for any reason. In the event that IT Works LLC terminates this agreement, the subscriber will receive a pro-rated refund of any unused fees paid in advance.

Effect of Termination

  1. Upon termination of this agreement, the subscriber's access to the service will be discontinued, and any outstanding fees or charges will become immediately due and payable. The subscriber must return any and all hardware provided by IT Works LLC within 30 days of the termination date. If the subscriber fails to return the hardware, the subscriber agrees to pay IT Works LLC $150.

This acceptable use policy applies to all users utilizing IT WORKS Internet services. A “user” is anyone who makes use of the IT WORKS Internet connectivity.  IT WORKS is the final authority over user activity. This policy is a summarization of what IT WORKS deems acceptable and unacceptable uses of its services. IT WORKS LLC reserves the right to restrict or terminate service at any time and for any reason.

Violation of these Policies may result in termination.

INTERNET SECURITY -  is the sole responsibility of each subscriber to protect their computer(s), data and network accessibility (such as file sharing). It is solely your responsibility for implementing sufficient procedures and checkpoints to satisfy your network security.

 

CHILD PORNOGRAPHY- Services shall not be used to publish, submit/receive, upload/download, post, use, copy or otherwise produce, transmit, distribute or store child pornography. Suspected violations of this prohibition may be reported to IT WORKS LLC  at the following e-mail address: safety@emailitw.com. IT WORKS LLC will report any discovered violation of this prohibition to the National Center for Missing and Exploited Children and take steps to remove child pornography (or otherwise block access to the content determined to contain child pornography) from its servers.

 

VIOLATION OF INTELLECTUAL PROPERTY RIGHTS - Service shall not be used to send/receive, upload/download, post, copy or otherwise reproduce, or store any content/material or to engage in any activity that violates intellectual property rights.

 

THREATENING MATERIAL OR CONTENT- Service shall not be used to send/receive, upload/download, post, create content of any kind that harasses, or threatens the health or safety of others.

 

INAPPROPRIATE INTERACTION WITH MINORS - IT WORKS LLC complies with all applicable laws pertaining to the protection of minors.  IT WORKS LLC will report cases of child exploitation to the National Center for Missing and Exploited Children. ILLEGAL ACTIVITY - Illegal activity of any kind is not permitted. This includes violation of all applicable domestic laws, and all laws governing any service or site you access on the Internet

 

DISCLAIMER OF LIABILITY FOR CONTENT - In no event shall IT WORKS LLC or any affiliation be held liable or responsible for any content on the Internet. In our belief, it is not our area to act as a judge or censor.  IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS, YOU SHOULD IMMEDIATELY DISCONTINUE SERVICE.
